1. Agreement to Terms

By accessing or using Beyflo (the "Service") operated by Beyflo ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

Beyflo provides an AI-powered phone answering service for businesses. The Service answers incoming calls, captures caller information, schedules appointments, and sends follow-up communications on your behalf. The Service is available at www.beyflo.com.

3. Account Responsibilities

When you create an account, you agree to:

• Provide accurate and complete registration information.
• Maintain the security of your account credentials.
• Promptly notify us of any unauthorized use of your account.
• Accept responsibility for all activity that occurs under your account.

You must be at least 18 years old to use the Service.

4. Billing and Subscriptions

The Service is offered on a subscription basis. By subscribing, you agree to the following:

• Before purchase, the checkout or signed order identifies the billing interval, amount or pricing method, renewal period, and how to cancel.
• A recurring subscription automatically renews for the disclosed renewal period and charge unless you cancel before the next billing date.
• We will not charge a recurring subscription without express affirmative consent to the automatic-renewal terms. Consent to general terms is not a substitute for any separate renewal consent required at checkout.
• After enrollment, we provide a retainable acknowledgment of the renewal terms, cancellation policy, and cancellation method.
• You may cancel online through the cancellation page. Canceling stops future renewal and does not require hearing or accepting a retention offer.
• Fees are non-refundable except as stated in the applicable order or required by law. If payment fails, we may suspend service while payment is resolved.
• Phone usage, numbers, integrations, or other scoped items may incur additional disclosed charges.

A free or discounted trial does not convert to a paid recurring subscription unless the post-trial price, timing, renewal terms, and cancellation method are clearly disclosed and you expressly consent. We send renewal, annual, trial-ending, and price-change notices when required by applicable law.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Transmit spam, unsolicited communications, or fraudulent content.
• Impersonate any person or entity, or misrepresent your affiliation.
• Interfere with or disrupt the Service or its infrastructure.
• Attempt to gain unauthorized access to any part of the Service.
• Use the Service for any purpose that is illegal, harmful, or deceptive.
• Resell, sublicense, or redistribute the Service without our written consent.

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

The Service, including its design, code, features, and content, is owned by Beyflo and protected by intellectual property laws. You retain ownership of any content you provide to the Service (business information, call scripts, etc.). By using the Service, you grant us a limited license to use your content solely to operate the Service on your behalf.

7. Limitation of Liability

To the maximum extent permitted by law, Beyflo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Indemnification

You agree to indemnify and hold harmless Beyflo, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

9. Termination

You may cancel your subscription and close your account at any time. We may suspend or terminate your access to the Service at our discretion if you breach these Terms or for any other reason with reasonable notice.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where another jurisdiction's mandatory consumer law applies. Any arbitration requirement must appear in an applicable signed customer agreement; otherwise disputes may be brought in a court with jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated terms.
